This counts calendar days, not working days, which is how notice periods are written in almost every Australian contract and award. Check yours before you commit to the date: if you’re covered by an award, the Fair Work Ombudsman’s notice and redundancy calculator will tell you what you owe. Where your notice period comes from
Not from the National Employment Standards. The NES minimum notice periods apply when your employer ends your employment, not when you end it. Yours comes from one of three places, in this order.
- Your contract. Whatever you signed, as long as it isn’t less than your award requires.
- Your award or enterprise agreement. Award notice is based on your continuous service with that employer.
- Nothing at all. Casual employees don’t have to give notice, and neither do employees with no award, no agreement and a contract that’s silent on it.
Once you have your date, the resignation letter templates will put it in writing.
